This judge figured out exactly how this "Watchtower dog hunts." When did WT file it's claim that 'it's just too inconvenient for our witnesses to travel to PA?
Judge Jenkins points out that the WT waited until THE NIGHT BEFORE THE TRIAL to file a " forum non conveniens” … even though the defendants had come to give their depositions the day before, without complaint.
“The Court added: “A transfer petition should not be a tool by which a defendant may forestall litigation in the underlying case by generating litigation concerning the transfer petition.”3
Pg 16 “the Congregations (WT & witnesses) “Delayed filing their motion to transfer and supporting affidavits from four witnesses until the eve of trial – after the witnesses had appeared without objection for their depositions in Montgomery County, just twenty miles from center City Philadelphia”
"Transfer to York County could significantly delay trial, a troubling possibility given that trial was scheduled to begin in PA just two weeks after the court granted the Congregations’ motion for transfer…”
"The facts strongly suggest that the motion to transfer venue was the product of bad-faith collaboration between the Congregations and the four York County Witnesses”.
Pg 17 The Congregations’ motion for transfer was not to avoid oppression……. But was a last-minute gambit to delay trial.”
Thanks to all who keep up the hard work of getting the real facts! Trey Bundy, Barbara Anderson, Irwin Zalkin, Steven Unthank & all the rest!!!
